1. Scope and provider

These General Terms and Conditions (GTC) apply to all orders placed via the Devero Eyewear online shop. The contracting party is HFX Solutions Avagliano, owner Danilo Avagliano, Wallenmattstrasse 4, 5742 Kölliken, Switzerland, UID CHE-395.690.284 (hereinafter “Devero Eyewear”, “we”). Deviating terms of the customer (hereinafter “Customer”) apply only if we have expressly agreed to them in writing.

2. Conclusion of contract

The presentation of products in the shop does not constitute a binding offer but an invitation to order. By submitting an order, the Customer makes a binding offer. Receipt of the order is confirmed automatically by email; this confirmation does not yet constitute acceptance. The contract is concluded upon our shipping confirmation or upon delivery. We may decline orders without giving reasons, for example in the event of obvious pricing or transmission errors; in this case, any payments already made will be refunded in full.

3. Prices

All prices are stated in the currency selected in the shop. The price at the time of ordering is authoritative. Shipping costs are shown separately before the order is completed. For deliveries outside Switzerland, customs duties, import taxes or fees of the destination country may apply; unless these are shown as included at checkout, they are borne by the Customer.

4. Payment

The available payment methods are shown at checkout. Payment is due upon completion of the order. Payments are processed via Shopify and the respective payment service providers.

5. Delivery

We deliver to the countries offered at checkout. The estimated delivery time is shown at checkout; delivery times are non-binding unless expressly agreed otherwise. Partial deliveries are permitted insofar as they are reasonable for the Customer; they do not incur any additional shipping costs. Risk passes to the Customer upon handover of the goods.

6. Retention of title

The goods remain our property until paid for in full, insofar as this is permitted under the applicable law.

7. Returns and right of withdrawal

We grant a voluntary right of return of 30 days from receipt of the goods. The goods must be unworn, undamaged and in their original packaging. The costs of return shipping are borne by the Customer, except in the case of defective or incorrect delivery. Refunds are made within 14 days of receipt and inspection of the return. Consumers resident in the EU additionally have the statutory 14-day right of withdrawal; details and the model withdrawal form can be found in our information on the right of withdrawal. The voluntary right of return does not restrict any statutory rights.

8. Warranty

The statutory warranty provisions apply. For consumers resident in Switzerland, the warranty period is two years from delivery; for consumers in the EU, the mandatory provisions of their country of residence apply. Defects must be reported to us by email without delay after discovery, stating the order number and enclosing photos. At our discretion, we may repair, provide a replacement or refund the purchase price, unless mandatory law provides otherwise. Normal wear and tear, improper handling or care (e.g. scratches caused by unsuitable cleaning, heat damage) do not constitute defects.

9. Product information

Colours may differ slightly from their presentation depending on the screen. Sunglasses are not suitable for looking directly into the sun, for protection against artificial light sources (e.g. solariums) or for driving at dusk or at night. Information on the filter category and UV protection is provided for each product.

10. Liability

We accept unlimited liability for damage caused intentionally or through gross negligence, as well as under mandatory statutory provisions, in particular the Product Liability Act. Otherwise, liability is excluded to the extent permitted by law.

11. Data protection

Information on the processing of personal data can be found in our Privacy Policy.

12. Applicable law and place of jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). With regard to consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by the mandatory provisions of the law of the country of their habitual residence. To the extent permitted by law, the place of jurisdiction is the registered office of Devero Eyewear. Mandatory places of jurisdiction for consumers remain reserved.

13. Final provisions

Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected. The German version of these terms and conditions is authoritative.
